Disclosure


All sessions aren't the same and some may require more or less work to complete. With this in mind, All sessions without a due date will be on a time frame of 10-14 days to complete. If there is a due date or preferred competition time, this is something that must be disclosed and acknowledged at the time of booking to ensure that I can meet those expectations and also so that proper compensation or (rush fees) may be applied to total cost of the production. In summary, No due date = 10-14 business days of completion time.

1. COPYRIGHT

i. The copyright Designs and Patents Acts assign the copyright of the images to the photographer. 

"I produced the photos, I own the photos completely unless the client purchases the exclusive rights"

2. DISPLAY

i. The photographer retains the rights to display any photograph to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc. 


ii. Only final retouched images shall be displayed by the client. 


3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION

i. Photographs taken during the session will be at the discretion of the photographer although every effort will be made to acknowledge the clients requirements. 


ii. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honour the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather an the availability and willingness of subjects.


iii. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. 


4. PAYMENT

i. A non-refundable booking fee of 50% will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer's booking page. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due. 


ii. Payment in full of the remaining balance will be due at the end of the session. 


iii. Additional goods ordered must be paid for in full at the time of ordering. 


iv. Titles to all goods remains with the photographer until paid for in full by the client(s) 


5. FORCE MAJEURE

i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid. 


ii. The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc. 


6. DIGITAL NEGATIVE FILES

i. All digital negatives (computer files) remain the property of the photographer and do not have to be released. Photographer retains the rights to decline the request of digital negatives. 


7. PERSONAL ACCIDENT

i. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. 


9. CANCELLATION FEES

i. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation: 


10. DELIVERY

i. Rush delivery has a fee of $100.00 and is limited to 10 Edited images. Delivery of final photos are estimated between 10-14 Business Days. Photographer will disclose the volume to the client for acknowledgment. Client must disclose expectancy date if it falls outside of each of these parameters it is the responsibility of the client to acknowledge and plan accordingly. Photography final images are NOT required to next day turnaround. Photographer is not obligated to retouch entire session. If client becomes belligerent in any form which includes excessive contact about images and/or turn-around, photographer retains the rights to terminate communication with client and is not responsible for further communication. 


11. Client Confidentiality 

The photographer will keep confidential and will not disclose to any third parties of private photos taken which include nudity and sexual natured pieced unless the client requests the release of such materials. 


12. Tardiness 

If the client is more than 20 minutes late to location or set or causes production to commence later than agreed upon start time, an additional fee of $125 is due at the time of arrival or commencement. If the client is more than 30 minutes late, the session will be cancelled and no refund of any form is offered. 


13. Reschedule Fee

If the client needs to reschedule their session, a fee of $25 is due to re-book the date. If the Photographer has to reschedule, the client can reschedule for free or receive a refund of the amount paid outside of the retainer deposit.


14. Creative Direction

Concepts are a form of service that isn't inclusive with actually taking photos. Creative Direction with have a base fee of an additional $150.00 for ideas (Intellectual Property) and the organization and execution to develop your images. I also have an additional creative director available for consultation which begins at $50 for conference and any research performed to develop your vision.


15. Communication

Communication about your project will begin with the client assessment email. Once this is completed by the client I will contact you via email and or phone. All conversations will be scheduled via the booking site. You will have three free consultations before fees begin. Conversation will also take place during working hours of operation. No social media DMs or unauthorized phone calls are permitted. If client becomes belligerent in any form which includes persistent insubordination of communication policies, the photographer retains the rights to terminate communication with client and is not responsible for further communication.
